Restrictions on Import of Laptops, Tablets, Personal Computers: What You Need to Know

In a move to regulate the import of certain electronic devices, the Directorate General of Foreign Trade (DGFT) has introduced new guidelines through Notification No. 23/2023 dated 03-08-2023. These changes will impact the import of laptops, tablets, all-in-one personal computers, ultra small form factor computers, and servers categorized under the HSN code 8471. As per the new notification, the import of laptops, tablets, all-in-one personal computers, ultra small form factor computers, and servers falling under the HSN code 8471 has been placed under the ‘Restricted’ category. This means that to import these items, you will require a valid License for Restricted Imports.

Exemptions and Relaxations

However, there are specific cases where these restrictions will not apply:

  1. Baggage Rules: Imports under the Baggage Rules, as amended from time to time, are exempt from these restrictions.
  2. Personal Use Import: Import of a single laptop, tablet, all-in-one personal computer, or ultra small form factor computer (excluding servers), including those purchased from e-commerce portals, through post or courier, is allowed.
  3. R&D and Testing: Import of up to 20 items per consignment for purposes such as research and development, testing, benchmarking, evaluation, repair and re-export, and product development is permitted. These items must be used for their intended purposes only and should not be sold. After their intended use, they must either be destroyed or re-exported.
  4. Re-import of Repaired Goods: Goods repaired abroad, as referred to under Para 2.28 of the Foreign Trade Policy (FTP) 2023, can be re-imported without the need for a Restricted Imports License.
  5. Essential Capital Goods: Import of items that are essential components of a capital good is exempt from these restrictions.

Effective Date and Transition Period

The new regulations regarding restriction on import of laptops, tablets etc.  outlined in Notification No. 23/2023 will come into effect from 01-11-2023. To ensure a smooth transition, DGFT has extended the applicability of this notification through Notification No. 26/2023 dated 04.08.2023. This means that import consignments of laptops, tablets, all-in-one personal computers, ultra small form factor computers, and servers under HSN 8471 can be cleared without a Restricted Imports License until 31.10.2023. However, for consignments cleared on or after 01.11.2023, a valid License for Restricted Imports will be mandatory.
